Statement
GDPR stands for General Data Protection Regulation and replaces the previous Data Protection directives we adhered to. The GDPR was approved by EU Parliament in 2016 and came into force on 25th May 2018.
GDPR states that personal data should be “processed fairly & lawfully” and “collected for specified, explicit and legitimate purposes” and that individuals data is not processed without their knowledge and without their “explicit” consent. GDPR covers personal data relating to individuals. Center Stage School of Dance is committed to protecting the rights and freedoms of individuals with respect to the processing of children’s, parents and guardians, visitors and any members of our teaching team personal data.
The Data Protection Act gives individuals the right to know what information is held about them, It provides a framework to ensure that personal data is handled properly.
GDPR includes 7 rights for individuals
The right to be informed
Center Stage School of Dance is a registered dance school with the BATD and as such is required to collect and manage certain data. We need to know parents’ names, addresses, contact telephone numbers and email addresses. We also are required to know children’s full names, addresses, date of birth, any relevant medical conditions or additional support needs. We may be required to pass parts of this data onto the BATD for examination entries. The information for examination entries includes children’s names, age. Date of birth and gender. This information is collated on paper forms submitted to our visiting examiner who then passes them to BATD head office for processing of results and certificates.
We record all parents and childrens’ data in our online cloud based and password protected database controlled by the principal teacher at all times. Our online cloud based system is GDPR compliant.On occasions where the principal teacher is not present other class teachers may be required to access this information should the need to contact a parent urgently. Childrens’ health and medical conditions may also be shared with teaching staff to enable us to fully support all pupils’ needs.
We are required to collect certain details of visitors to any branches of our dance school. We need to know names, telephone numbers and where appropriate company name. This is in respect of our health and safety and Child Protection policy (please note we operate under the BATD Child protection policy).
Center Stage School of Dance is required to hold data on any teaching staff (voluntary or freelance included). We require teachers’ names, addresses, telephone numbers, email addresses and qualifications and insurance details where appropriate. This information is also required for submission of PVG screening. This information will be held within our electronic database and shared only with the relevant companies to process applications for PVG.
2. The right of access
At any point an individual can make a request relating to their data and Center Stage School of Dance will need to provide a response (within 1 month). Center Stage School of Dance can refuse a request if we have lawful obligation to retain the data but we will inform the individual of the reasons for the rejection. The individual will have the right to complain to the ICO if they are not happy with this decision.
3. The right to erasure
You have the right to request the deletion of your data where there is no compelling reason for its continued use. However Center Stage School of Dance have a legal duty to keep children’s and parents details for a reasonable time*, Center Stage will retain these records for 3 years in our database as an inactive customer/pupil after leaving the school, children’s accident and injury records for 5 years for Child Protection records. This data is archived in our cloud based password protected online database and any paper registration forms are shredded once added to this system. Following the legal retention period we will delete your records.
4. The right to restrict processing
Parents, visitors and members of our teaching team (voluntary or freelance) can object to Center Stage School of Dance processing their data. This means that their data can be stored but not used in any way, e.g. reports or methods of communication.
5. The right to data portability
Center Stage requires data to be transferred from one electronic database to paper examination forms to the BATD. The BATD operate their own policies and procedures for protecting the such information in ratio to GDPR.
6. The right to object
Parents, visitors and members of our teaching team can object to their data being used for certain activities like marketing, research and promotional information relating to Center Stage School of Dance events.
7. The right not to be subject to automated decision making including profiling
Automated decisions and profiling are used for marketing based organisations. Center Stage School of Dance does not use personal data for such purposes.
Storage and use of personal information
All paper copies of registration forms, examination records etc are held by the principal teacher in a file placed in a locked fireproof box at their home address. Paper copies of registration forms will be destroyed once they have been added to our online cloud based password protected system which is GDPR compliant. Members of the teaching team may have access to these files but information taken from the files about individuals is confidential and these records will be only be shared by the principal teacher, access to our online database will be restricted and members of teaching team would only have access to the information deemed essential by the principal teacher.
Information about individual children is used in certain documents, weekly registers stored on password protected ipad, medical forms and applications to external agencies, for example the BATD.These documents include data such as children’s names, date of birth, age and gender. Examination records are held by the principal teacher in locked file at their home address.
Center Stage School of Dance collects a large amount of personal data every year including name, contact numbers and email addresses of parents and children on the waiting lists. These records would be deleted if the child does not register with us or transferred to our active pupils list within our electronic database.
Center Stage School of Dance stores personal data held visually in photographs or video clips. Consent to inclusion of children in this is obtained in accepting our terms and conditions when registering with us and in your continued attendance to our classes. No names are stored with images in photo albums, displays, or on Center Stage School of Dance’s social media sites. Please note in recognition of individual pupil achievement or birthday celebration the child’s name only may be used on social media posts. This information would only be shared within the private parents group on Facebook. For individual consent would be obtained in writing if images or videos are used for advertising purposes in either printed fliers, posters or social media sites.
Access to any electronic devices containing Center Stage School of Dance data i.e. the iPad, principal teacher’s mobile phone and laptop computer is password protected. In the event of a member of the teaching team leaving then these passwords would be changed. Please note members of the teaching team’s access is restricted to the school iPad.
USE OF DATA PROCESSORS
Data processors are third party organisations who provide services for us (e.g. our uniform printing company). We have contracts in place with data processors which means they cannot share anything with your personal information with any other company except us. Please note our uniform printing company only obtains children’s first names for printing on personalised items.
GDPR means that Center Stage School of Dance must:
-manage and process personal data properly
-protect the individual’s rights to privacy
-provide an individual with access to all personal information held on them.
